Terms of Service

1. General Terms

- Prices are subject to change based on demand;

- I have the right to reject any order for any reason;

- I require proper credit and I have the right to use it as self-promotion and post my art and if you don't want the piece to be uploaded on my socials please let me know beforehand.

2. Payment & Refunds

- Currency accepted is either USD, EUR or GBP and can be paid through PayPal only;

- Commissions can be paid 100% upfront;

- Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment;

- The buyer have no right to cancel or demand a refund from the artist under any circumstances after payment is received. This is important due to all my PayPal payments being converted to my currency, which automatically transfers all quantity to my bank account.

3. Process & Delivery

- The time it takes to finish your commission varies 1 week - 2 months depending on factors such as health, the complexity of the commissioned piece, or other work;

- Once I start your commission, I will be sending all the work-in-progress through Direct Messages;

- You are free to DM me asking about your commission and I will always reply as fast as I can, but please understand that I have a life to attend and I don't have the time to individually DM each one of my clients updating about my situation, but I will always keep my Commission's Status updated;

- When the piece is finished you will receive the full-resolution artwork by e-mail;

4. Revisions

- A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.

- If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.

5. Copyright & Usage

> Me, Luddi Lunière (the artist):

- I reserve the right to cancel and refund the order at any time for any reason.

- I retain all copyrights over the commissioned artwork.

- I reserve the right to post the commissioned artwork online.

> You (the customer/commissioner):

- You may upload the commissioned artwork on any website and social channels with CREDIT ONLY;

- You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.);

- You may NOT alter the commissioned artwork without my (the artist's) consent;

- You MAY be allowed to sell the artwork if it is a part of an Adoptable. Also being sold with other artworks;

- You may NOT use the commissioned artwork for commercial purposes, UNLESS if we have an agreement about the commissioned artwork.

> The following is considered copyright infringement:

- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms;

- Claiming the artwork as your own;

- Altering the artwork without my consent.

TERMOS DE SERVIÇO

1. Termos Gerais

- Os preços estão sujeitos a alterações de acordo com a demanda.

- Tenho o direito de rejeitar qualquer pedido por qualquer motivo.

2. Pagamentos & Reembolso

- As moedas aceitas são em BRL (real) para brasileiros e podem ser pagas através do Pix ou por Depósito Bancário;

- As comissões são pagas 100% adiantadas. Eu começarei sua comissão assim que receber o pagamento total;

- Não me envie nenhum pagamento antes de eu concordar em lhe dar uma vaga e solicitar que você me envie o pagamento;

- O comprador não tem direito a reembolso uma vez que comecei a trabalhar na comissão;

- O comprador pode obter um reembolso de 70% por PIX, se por algum motivo, eu não iniciei sua comissão.

3. Processo & Entrega

- O tempo que leva para terminar sua encomenda varia de 1 semana a 2 meses, dependendo de fatores como saúde, complexidade da peça encomendada ou outro trabalho;

- Assim que a peça for finalizada receberá a imagem em alta resolução por e-mail;

- Você está livre para me enviar DM perguntando sobre sua comissão e sempre responderei o mais rápido possível, mas entenda que tenho uma vida para atender e não tenho tempo para enviar individualmente cada um de meus clientes atualizando sobre minha situação mas eu sempre deixarei meu Commission's Status atualizado.

4. Revisões

- Será adicionada uma taxa se você quiser que algo seja alterado no desenho final - a menos que um mal-entendido da minha parte tenha sido cometido.

- Se desejar que eu altere algo no desenho que você aprovou anteriormente, cobrarei uma taxa para alterá-lo. O valor da cobrança extra depende da alteração que você deseja que eu faça.

5. Direitos Autorais & Uso

> Eu, Luddi Lunière (o artista):

- Eu me reservo o direito de cancelar e reembolsar o pedido a qualquer momento por qualquer motivo.

- Eu mantenho todos os direitos autorais sobre a arte comissionada.

- Eu me reservo o direito de publicar a arte encomendada online.

> Você (o cliente):

- Você pode fazer o upload da obra de arte encomendada em qualquer site e canais sociais.

- Você NÃO pode lucrar com a peça encomendada (revenda, redistribuição, upload para serviços POD, impressão, etc.)

- Você NÃO pode alterar a obra de arte encomendada sem o meu consentimento (do artista).

- Você PODE ter permissão para vender a obra de arte se ela fizer parte de um Adopt. Sendo vendida com outras artes.

- Você NÃO pode usar a arte encomendada para fins comerciais. A NÃO SER QUE tenhamos feito algum acordo sobre a arte comissionada.

> O seguinte é considerado violação de direitos autorais:

- Reproduzir / usar comercialmente a obra de arte protegida por direitos autorais - significa ganhar dinheiro com ela de qualquer forma não excluída destes termos.

- Reivindicar a obra de arte como sua.

- Alterar a obra de arte sem meu consentimento.
